24, 2021 /PRNewswire/ - Record volumes were recorded this past weekend for legal U.S. Online gaming and sports betting. By making sports wagering bookies illegal, the nation handed it over to criminal enterprises. That changed somewhat in 1931 when Nevada legalized gambling. The Interstate Wire Act of 1961 helped to stem criminal involvement further. Government came out with the act to protect state lotteries. Anything out of the ordinary! He is conflicted to flip the table. He stares endlessly into the table's polished wood. He gazes upon the earth in wonderment. He throws caution to the wind and grabs it by its side. But then he stops. He looks at the floor surrounding him.

Chapter 849, Chapter 550, and Chapter 551 govern gambling in Florida. Gambling or being associated in some form with gambling is generally prohibited unless it falls into a few exceptions such as charity Bingo, the Florida State Lottery, pari-mutuel facilities, penny ante betting, etc.

Bookmaking is illegal in Florida. A bookmaker is a misnomer. It is not illegal to make books, but it is illegal to receive bets on agreed upon odds. A bookmaker, sometimes called a “bookie” or “turf accountant,” takes bets from individuals and then pays out or collects money based upon what his book says about who-owes-who what amount of money. A bookmaker needs his book to keep track of all the bets, which is why he is called a bookmaker.

Florida Statute 849.25 - Illegal Bookmaking What the State Prosecutor has to Prove to Convict a Defendant of Bookmaking

The state prosecutor has to prove beyond a reasonable doubt:

  1. The defendant was engaged in the business or profession of gambling;
  2. While so engaged, the defendant took or received a bet or wager; and

    1. A trial or contest of skill, speed, power, or endurance of man, beast, fowl, motor vehicles, or mechanical apparatus; or
    2. A chance, casualty, or an unknown or contingent event.

The state prosecutor needs to show only two factors from the following list to get to trial:

  • Taking advantage of betting odds created to produce a profit for the bookmaker or charging a percentage on accepted wagers.
  • Placing all or part of accepted wagers with other bookmakers to reduce the chance of financial loss.
  • Taking or receiving more than five wagers in any single day.
  • Taking or receiving wagers totaling more than $500 in any single day, or more than $1,500 in any single week.
  • Engaging in a common scheme with two or more persons to take or receive wagers.
  • Taking or receiving wagers on both sides of a contest at the identical point spread.
  • Any other factor relevant to establishing that the operating procedures of such person are commercial in nature.

They handle all the ins and outs and technical stuff in regards to bookmaking, which makes it easy for just about anyone to become an agent and book action on sports.

This means that you as the bookie do not even need to know much about sports or gambling, however, the more you know the better, in order to be a successful bookie. Instead, all you need to know as the bookie is just people that want to gamble. This is easily done by using word of mouth and speaking to all friends, members of your family, people from your work, classmates, social media friends and acquaintances and asking if they would like to gamble.

Illegal

Once you start getting the word out, you will be surprised by how many people actually do have an interest in making wagers. Then the sky is the limit, with the more people you have making wagers with you the more money you will end up earning over the long term. Is Online Betting Legal in the United States?

Is Bookie Illegal

The legality of sports betting has and is a complex issue, as the legal precedence has changed over the last couple of years. For a while, there was a federal ban on sports betting from 1992 to 2018 under the Professional and Amateur Sports Protection Act (PASPA). The PASPA act did grant immunity to four states; Nevada, Delaware, Oregon, and Montana. Eventually, the state of New Jersey challenged the legality of PASPA, and the supreme court heard oral arguments in late 2017. This led to the eventual repeal of PASPA on May 14, 2018, as the Supreme Court voted 6-3 to repeal it. But once PASPA was repealed, the legality of sports betting is a decision made by each individual state. Currently, online sports betting is a state-wide issue rather than a federal law issue, so it is important to be aware of the laws in the state in which you reside.

Illegal

In short, the legality of sports betting is now determined by the state you live and operate in, not by the federal government. So are bookies illegal in the USA? It depends solely on your location.

Modern Law

Because the states determine the law, it is vital to know where each state stands on the issue of sports gambling. Because even if you reside in a state where sports gambling is legal, if you participate in it within the borders of a state where it is illegal, you are violating the law and be charged. If you are unaware of the law in the state you are visiting, either contact an attorney or look it up on a federal website (.gov). Being aware of the state laws will help any individual avoid such a situation.
